Acceptance of Terms
These general conditions define, without prejudice to the application of special conditions, the respective obligations of OliGranados, hereinafter referred to as the "seller", and any consumer wishing to make a purchase via the website of the seller, hereinafter referred to as the "buyer".
By checking the acceptance box for the General Terms and Conditions when placing an order, the buyer expressly acknowledges having accessed, read, understood, and unreservedly accepted them. It is understood that ordering a product via our website requires the consultation and express acceptance of these terms.
These Terms and Conditions are accessible at all times on our website www.oligranados.be and will prevail over any other document.
Provisions not expressly modified remain in effect. Only exceptions made through express written agreement can alter the application of these general conditions. It is agreed that in cases of discrepancy, specifically agreed-upon provisions will take precedence over general ones. Furthermore, in the event of any conflict between the customer's conditions and those of OliGranados, only the latter will prevail.
Unless proven otherwise, the data logged in the seller's computer system serves as evidence for all transactions made with the buyer.
The seller reserves the right to amend the terms of sale at any time. Should any changes be made, the conditions applicable will be those in effect at the date of the buyer's order.
Order
Orders can only be placed by individuals who are legally capable. To purchase a product, the buyer must complete the identification form, choose the delivery method, review and validate the order, acknowledge acceptance of the general terms and conditions, make payment as specified, and confirm the order and payment.
The sales contract between the seller and the buyer is concluded upon receipt of the confirmation email.
Products will not be shipped until the order is confirmed and full payment is received.
Cancellation of an order by the buyer is only possible before the products are dispatched.
Products are subject to availability. If an item is unavailable, the seller will promptly notify the buyer by email. The buyer can then opt to wait (for temporary unavailability) or cancel the order for unavailable items at no cost.
The seller reserves the right to request additional information from the buyer and to refuse certain orders. This may occur if the buyer is a minor, if there is an ongoing dispute, if stock availability does not permit order fulfillment, or if there is a manifest error in the description or price of the products.
Duration
These conditions apply throughout the entire duration of the order, our services, the delivery of goods, and all interactions between the buyer and the seller.
Product Information
The products available are those listed on the seller's website, subject to availability.
Each product is described based on information provided by the supplier.
Images and illustrations used to showcase the products are for reference only and may include items not included in the listed price.
Pricing
The prices of products listed on the site are in euros and include all applicable taxes.
Transportation costs are not included and will be added separately during checkout.
The seller reserves the right to modify the prices at any time. The prices applicable to the order are the ones in effect at the time when the order is confirmed.
Shipping and Delivery
Any delivery costs are indicated in the order summary before the buyer confirms the order.
Deliveries are made only to addresses within Belgium.
In the event that the buyer is not present at the specified delivery address upon delivery, the buyer or the designated recipient will receive a notification from the courier (via email, SMS, or postal notice) regarding re-delivery options or pickup from a designated collection point.
Oligranados makes every effort to process and ship orders as quickly as possible. Typically, delivery takes 2-3 business days from the time full payment is made for the order. However, the seller cannot guarantee exact delivery times. No compensation can be claimed by the buyer in the event of delayed delivery.
Payment Terms
Payment is made using Bancontact, Visa, Mastercard, PayPal, iDEAL, or bank transfer.
Ownership of the items ordered remains with the seller until the buyer has made full payment for the order.
Right of Withdrawal
The consumer can cancel the purchase order within 14 calendar days of receiving the order or concluding the service contract, without penalty and without giving reasons. After exercising the right of withdrawal, the consumer has an additional 14 days to return the goods. This right of cancellation does not apply to professional buyers.
The consumer can initiate the request through the website's contact page or by sending the completed withdrawal form (https://economie.fgov.be/sites/default/files/Files/Forms/Formulier-herroeping.pdf) via mail or email. The consumer may request either product exchange or reimbursement.
The buyer is responsible for return costs, and the items are transported at their own risk.
The consumer is notified that once sealed goods are unsealed after delivery, they cannot be returned.
The seller will reimburse all payments received from the buyer, including delivery costs but excluding return shipping costs. Refunds will be issued using the same payment method initially used by the buyer for the order.
The reimbursement will be processed within 14 working days from either the reception of the returned goods subject to the withdrawal request or the reception of proof of the return of said goods.
The seller reserves the right to issue only a partial refund if the returned item is damaged or incomplete.
Legal Guarantee
The buyer acting for private purposes is entitled to a two-year legal guarantee and other rights as specified in the Law of 1 September 2004 on the protection of consumers for the sale of consumer goods.
As per Article 1649 quater §2 of the Civil Code, the consumer must notify the seller of any lack of conformity within two months from the date of discovery of the defect.
The invoice or delivery note serves as the guarantee document and should be retained by the consumer.
